ACCEPTANCE OF TERMS
IdentiSafe (“the Company” or “IdentiSafe”), which provides its services to you, subject to the following Terms of Service, which may be updated periodically without notice to you. You can review the most current version of the Terms of Service at any time on the Company’s website at https://identisafe.com/legal/terms/
When using IdentiSafe, you shall be subject to any guidelines or rules applicable that may be posted periodically on the IdentiSafe website. You understand and agree that violation of local, state or federal laws, the Company’s or Third Parties’ established policies and procedures might result in the immediate termination of this agreement at IdentiSafe’s sole discretion.
Please be aware that you must be at least 18 years of age to use IdentiSafe or any of its sites, including IdentiSafe.
DESCRIPTION OF SERVICE
IdentiSafe provides public record information (“the Service”) using a variety of personal information suppliers, technologies and public information databases (“Third Parties”).
You hereby authorize and instruct IdentiSafe to act as your agent by accessing and using any available online searchable databases on your behalf for the purpose of obtaining and gathering personal information about yourself for your use and benefit, and to request removal of your personal information from databases if you direct us to.
The public information that IdentiSafe obtains is delivered via the Internet by a digital dashboard that contains alert flags and nationwide public record information that is obtained from Third Parties, as well as proprietary databases and derived information.
Unless explicitly stated otherwise, any new features that augment or enhance the current Service – including the release of new IdentiSafe properties – shall be subject to the Terms of Service.
You hereby authorize IdentiSafe to communicate with you with routine status update emails, monthly emails, alert emails, and with information about other privacy and security products. security products.
IdentiSafe gives website visitors the option of subscribing to an identity theft newsletter distributed by IdentiSafe. That newsletter does not sell or rent the email addresses, but it does accept advertising for distribution to the mail list. You may opt-out of the newsletter by using the unsubscribe link on any newsletter.
You understand and agree that by using the Service either you or the Third Party supplying the product to you are responsible for paying the Company its applicable rates.
You understand and agree that along with the services that IdentiSafe provides, you may also receive certain communications from the Company, such as service announcements, administrative messages and newsletters.
You understand that these communications are considered a part of IdentiSafe membership and you will not be able to opt-out of receiving them.
You understand and agree that in order to use the Service you must be of legal age to form a binding contract, that you are not barred from using the services that IdentiSafe, including IdentiSafe, provides under the local, state and federal laws, or other applicable jurisdictions.
You also understand and agree that when using the Service you will provide true, accurate, current and complete information about yourself, and that you will maintain and update your personal information to ensure that it is true, accurate, current and complete.
You understand and agree that if you provide any information that is untrue, inaccurate, not current or incomplete that IdentiSafe has the right to immediately suspend or terminate your account, and refuse any and all current or future use of the Service.
You understand and agree that your Service subscription will automatically renew at the end of the predetermined time period (monthly or yearly), unless we are contacted by you or on your behalf to cancel your account, your subscription fee will remain the same.
MEMBER ACCOUNT, PASSWORD AND SECURITY
You understand and agree that you will receive account login information upon registering on the IdentiSafe website. You are responsible for maintaining the confidentiality of the password and your account information, and are fully responsible for any and all activities that occur under your password or account.
You agree to notify IdentiSafe immediately of any unauthorized use of your account, or any breach of security. You also agree to ensure that you will log out of your account at the end of each session.
You also understand and agree that IdentiSafe or the Company is not liable for any damage or loss that results from your failure to comply with the Terms of Service.
You agree and understand that you will not use the Service to obtain information about a person other than yourself. You understand and agree that this service is for researching your own information.
You also understand and agree that if IdentiSafe or the Company has reasonable grounds to suspect that you are trying to obtain information about someone other than yourself, it has the right to suspend or terminate your account, and refuse any and all current or future use of the Service.
You understand and agree that the Service IdentiSafe provides is “AS-IS,” and that IdentiSafe assumes no responsibility for the timeliness, deletion, failed delivery or failure to store any information obtained or distributed via the IdentiSafe website.
You understand and agree that since IdentiSafe and the Company obtains data from Third Parties that the information may, or may not be, completely thorough and accurate. You shall not rely upon IdentiSafe for the accuracy or completeness of information supplied in using the Service.
LIABILITY / WARRANTY
Neither IdentiSafe and the Company (nor IdentiSafe’s data providers / Third Parties) shall be liable for any loss or injury that may arise out of the Company’s acts or omissions, whether negligent or otherwise, in obtaining, distributing, compiling, collecting, interpreting, reporting, communicating or delivering the Service.
By using the IdentiSafe website, you understand and agree that every business decision involves assumption of a risk, and that IdentiSafe and the Company does not underwrite that risk in any manner whatsoever.
You also understand and agree that in no event shall IdentiSafe be liable for any incidental, indirect or consequential damages, however arising, incurred from receipt or use of information delivered hereunder, or the unavailability thereof.
You understand and agree that these Terms of Service grant you a limited license in exchange for payment, and that you shall not reproduce, print, retransmit, republish or otherwise transfer, any information received via IdentiSafe.
You also understand and agree that you are the end user of the information obtained by using the Service.
You also agree that you are not accessing information via the Service on public figures, including names in the news, media personalities, political personalities, etc.
FAIR CREDIT REPORTING ACT
You understand and agree not to use the Service for consumer credit purposes, consumer insurance underwriting, pre-employment purposes, tenant screening purposes, or for other purpose(s) covered by the federal Fair Credit Reporting Act (15 U.S.C Sec. 1681 et seq.) or similar statute.
You understand and agree to use the Service in strict compliance with the Gramm-Leach Bliley Act (U.S.C. Title 15, Chapter 94, Section 6801 et seq.) and similar state statutes, if applicable.
IdentiSafe guarantees that the information we provide is obtained from a variety of the most accurate and reliable sources (“Third Parties”) available to us.
SUBSCRIPTION, CANCELLATION AND REFUND POLICY
Your subscription will automatically renew unless automatically cancelled. All of our plans are subscriptions either in a monthly or annual term. You may cancel your membership at any time before your next subscription charge.
You may cancel your account with a full refund within 30 days of your initial purchase (“Money Back Guarantee”).
Refunds beyond the 30-day purchase window will be considered, at the sole discretion of IdentiSafe, if a Subscriber can demonstrate that the Service was not available or usable during the subscription period and that reasonable attempts were made to contact IdentiSafe to resolve the issue. In this case, IdentiSafe may provide the Subscriber with a pro-rata refund of service fees paid during the period when the Service was not available or usable.
Refunds are generally processed within seven (7) days, and are made to the original form of payment used for purchase. All refunds are sent in USD and therefore the refund amount could differ from the amount originally paid in local currency or bitcoin.
Any change to the original purchase, such as upgrading to an extended billing term or purchasing of additional licenses under the same account, shall constitute a waiver of the Money Back Guarantee option.
